This Doctor Consulting Agreement is made
BETWEEN
AND
Elab Pathology Sdn (No. 1507629-V) at No. 26A, Jalan BP7/11, Bukit Puchong, 47120 Puchong, Selangor (“The Provider”).
1. Appointment Scheduling:
Clients (Target Audience) are encouraged to schedule appointments in advance to ensure timely consultation.
2. Consultation Scope:
During consultations, doctors will address the primary concerns outlined by the Target Audience.
3. Additional Services:
Any additional services beyond the initial consultation may be provided at the doctor’s discretion. (Refer to clause 13.4)
4. Patient Information Privacy:
All client information shared during consultations is treated with strict confidentiality under PDPA regulations.
5. Treatment Recommendations:
Doctors may recommend further tests or treatments based on clinical assessment and client needs. (Refer to clause 13.11)
6. Informed Consent:
Clients will be informed about the purpose, risks, and benefits of any recommended treatments or tests, ensuring informed consent.
7. Billing:
A doctor receives a fee of RM25.00 for providing phlebotomy services at their clinic, as requested by the patient through an appointment via the Clinical app. However, if the patient requests an additional consultation with the doctor, the doctor will receive an additional payment of RM40.00 as a consultation fee.
7.1. Terms:
All payments shall be made on or before the last day of each calendar month.
8. Follow-up Care:
Clients will receive guidance on follow-up care and appointments as necessary.
9. Emergency Situations:
In emergencies, doctors will provide necessary medical care to the best of their abilities.
10. Subscription Fee:
The doctor may maintain their partnership with ELab without a subscription fee for a period of five years, after which it will continue at the discretion of the company. However, once ELab officially launches, a subscription fee would be charged to clinics that choose to join after the official launch.
11. Clinic Policies:
Clients are expected to adhere to clinic policies and procedures during their visit.
12. Legal Compliance:
The consultation will be conducted in compliance with all relevant medical laws and regulations.
13. Clinic SOP’s:
13.1. Preparation of Sample Tubes:
Clinic staff must prepare all relevant tubes with the client’s written name and identification number as per the prerequisites from the Clinical app.
13.2. Client Appointment Procedure:
Clients (walk-in or app users) should visit their appointed clinic at the scheduled date and time for phlebotomy services.
13.3. Priority for ELab Clients:
ELab clients will receive priority service without needing to register as patients or wait in the clinic queue.
13.4. Scope of Phlebotomy Services:
Doctors are not obligated to provide additional services unless the client chooses to do so at their discretion.
13.5. Completion of Phlebotomy Services:
Upon completing phlebotomy services, the clinic must fill in related fields such as Dr name, the sample collection time and PDPA clause before printing the prerequisite form.
13.6. Sample Collection Protocol:
If the laboratory does not respond within 4 hours of sample collection, the clinic may contact them for sample pickup.
13.7. Handling of Overnight Samples:
Overnight sample retention in the clinic is strictly discouraged.
13.8. Appointment After e-Reports:
Clients may request appointments once e-reports are available on their app and the Clinical app.
13.9. Recommendations by Doctors:
Doctors may advise clients on additional tests or treatments if necessary.
13.10. Additional Test:
Additional tests may be recommended based on the Clinical app’s supplementary test list provided by ELab.
13.11. Payment for Additional Tests:
Any charges for additional tests will be billed by the clinic and payable to ELab according to the tariffs specified in the Clinical app system.
13.12. Billing Guidelines:
Clinics are permitted to charge clients based on the Patient Price (PP), though they may offer lower prices at the discretion of the attending doctor.
13.13. Non-Standard Tests:
For tests not listed in the provided table, clinics must coordinate with ELab for test requests and billing purposes.
14. Disputes in Lab Reports:
Any disputes arising from lab reports shall be the responsibility of ELab.
15. Arbitration Clause:
Any disputes arising from or related to this Agreement shall be settled through binding arbitration administered by [Arbitration Provider] in the country and states of Malaysia. The arbitration shall be conducted in accordance with the rules and procedures of [Arbitration Provider]. The decision of the arbitrator(s) shall be final and binding upon both parties.
